Special election to be held for Duffy’s seat in January

MADISON, WI — Wisconsin Governor Tony Evers has issued an executive order regarding when a special election will be held to fill Congressman Sean Duffy’s vacant seat.

Due to Duffy’s resignation, which takes effect at 5 p.m. CT Monday, Evers says a primary for the seat, if necessary, will be held on December 30, and a special general election will be held on January 27.

Duffy, who represents Wisconsin’s 7th Congressional District, announced his resignation earlier this year after revealing the child he and his wife are expecting in October will have medical issues.

According to Evers’ office, the earliest date a primary could be held for Duffy’s seat, if needed, would be on December 24, and a special general election on January 21, however the announced dates were chosen due to the state’s Christmas Eve holiday conflict.

Evers’ office says the special election won’t be held at the same time as the spring election because people in northern Wisconsin wouldn’t be represented in the U.S. House of Representatives until more than six months after Duffy’s resignation.

Wisconsin state law indicates a governor can order a special election once a congressional seat becomes vacant, and the order must be issued 92 to 122 days before the special primary. The special primary, if necessary, must happen 28 days before the special general election. A special election can’t happen between February 1, 2020 and April 7, 2020, unless it aligns with the nonpartisan spring election.
